Number of fowl per dwelling or property. (a) It shall be unlawful for any person to keep, allow, maintain, or harbor outside of the residential structure, any fowl in any pen, shed, coop or structure, if any part of such pen, shed, coop or structure is within 50 feet of any residence, business or commercial establishment or office (other than the owner\'s), school, hospital, or nursing home. (b) No person shall keep, allow, maintain, or harbor more than five fowl on a single-family residentially zoned property. Chicks under six weeks of age born on the property or born from an animal legally existing on the property, shall not be counted for the purposes of this section. (c) No person shall keep, allow, maintain, or harbor any fowl on a duplex or multi-family zoned property, or for other zoning classifications except as authorized by the city\'s comprehensive zoning ordinance. (Ord. No. 07-2860, § 2, 6-12-07) Sec. 18-67. Allowing fowl at large prohibited. It shall be unlawful for any person to permit, suffer or allow any chicken, duck, turkey, goose or other fowl, owned, kept, or possessed by him or under his control to wander in or upon or invade the premises of any other person, unless the owner or person in charge of such premises shall consent thereto. (Code 1969, § 4-7) Sec. 18-3. Nuisances--Prohibited. No resident or inhabitant of the city shall maintain any animal in the residential area which will constitute a nuisance to the surrounding neighborhood resulting from obnoxious odors or unnecessary noise, or by not being confined to the property limits of the owner or by allowing the animal to defecate on public property or the property of others without removing the waste in a proper and sanitary manner.
