I don't think it's buyer beware at all. Craigslist is simply an advertising site, not a free-for-all scammer site. Contact the seller and tell them you want your money back and return the birds. I advertise on CL all the time, and customer service is a huge part of my selling.

This guy that was selling them sold me a salmon faverelle.....its not. His bantam hen he claimed was healthy had bad scaly leg mites. Now my flocks is being culled because his bird infected mine with sinus infections. I would never buy a cl bird again....thanks to him im no longer raising chickens. Ill buy store bought eggs. Its cheaper then buying meds that wont work if there always be carriers.
