City says chickens ok, HOA says no, what to do?

So, at first I was not really worried about my HOA. But then I decided that I should check just to make sure because I don't want to have to get rid of my chickens after I get them. So this is what the rule says:
Section 4. Animals
No animals, livestock or poultry of any kind shall be kept or maintained on any Lot or in
any dwelling except that dogs, cats or other household pets may be kept or maintained
provided that they are not kept or maintained for commercial purposes and are controlled
in accordance with applicable governmental ordinances are not a nuisance to other
Owners.
Does anyone see a loophole or should I just forget about getting chickens?? I want them real bad but am not sure I want to go up against a board just to be told no.

You could try emailing the city about having pet chickens. I did that, so that I'd have their response in writing. However, it could take a long time to get a response, and you may have to email more than once.
Hope you're able to get chickens!
 
Talk to other home owner's, see if there might be support among them, you might be surprised to find others with them same interest.

I was fortunate that a board member had also started a flock and when presented with the issue the board agreed to not regulate the backyard if it's fenced.

the problem with HOA, you have to abide their rules. If they say NO fowl or chickens, then you could not have any, regardless what the city laws says about poultry. If your city laws says you can have poultry, and your HOA says NO poultry, HOA will win.

time to move elsewhere in the city other than HOA. I would never move into a place that has HOA in its place.

Many of the houses were in my same zip code and many neighborhoods MUCH nicer than ours. I did not think I would have a problem with my HOA.
Maybe I can just get all silkies and say they are muppets.

And that's why I'd never purchase a home in an HOA. Do they stop by to measure the grass height too?

All you can do is ask. It's quite clear they don't consider chickens household pets. With a well prepared concise appeal showing a picture of the cute coop and run, only 3 or 4 hens and any other short factual information you may get a variance. Poultry gets a raw deal with misinformation or information based on mass birds in poor conditions. Noise, smell, ruined lawns...these are the things you have to address and inform the HOA of the contrary. Good Luck.

Or dumped!

I know the home has its perks but all in all, it won't hurt to ask the owner or read into your HOA contract.

well, I just contacted the HOA president. She wants me to email her with a proposal. I want my chickens so bad, they already have names....Lulu, Amelia, and Thelma.
Any suggestions on what I should say? Thank you in advance. I love BYC!
