Marty, if the title was not transferred or given to you, I would take the position that the vendor is a trustee of the goods and bears the risk of loss while on his property.

 

Bakin, they are lovely looking birds.  However, for that price I would wait for the dewlaps (assuming you want them for pets, not dinner).

My menagerie includes 5 horses, 3 dogs, 4 cats, 33 geese (dewlap toulouse & african) and 11 ducks (muscovy, ancona, cayuga & silver appleyard).

I was going to ask where in California, but I am pretty sure my DH would veto geese.  Especially since we still have 9 muscovies.

I don't know law, but that would seem logical.  BTW didn't you say you couldn't pick them up because he had them blocked in by his other cars, if so then it would really seem to be his problem.
