Have you ever reported an E-Bay listing for using your stolen picture?

Another chicken breeder is using my picture, along with other BYC members' pictures, to sell his hatching eggs. The breeds we own can go for quite a bit of $$, upwards of $50/dozen. He has NO pictures of his own on his listing, and they're selling well. I sent him a couple of messages asking about quality issues I knew my rooster had, but he answered without really answering my questions.

He continues to use my picture, now on his 3rd or 4th listing.

The main reason I'm upset, besides the fact that he's passing my birds off as his own, is that these buyers are purchasing something, thinking they're getting a quality item, but I doubt that they are since he won't use his own pics. I know it's buyer beware, but I feel like maybe I should let him know I know he stole my pics and the others and that he should remove them.

(I'm concerned he may retaliate, since he'll know my ebay member id.)

Have you ever reported stolen pictures on EBay? Do they ever act on the report? Any idea what I should do?

He's also a BYC member, but hasn't been here in a few months, and I'm also a little scared to PM him through here.
 
I would report it. That's fraudulent, and that's not okay. eBay takes fraud seriously so there's a good chance that they'll take care of it with him. You could also get in touch with eBay and tell them what's going on and that you're concerned and see what they say. A friend and I recently reported someone who was selling clearly hybrid hatching eggs as purebred and the seller is no longer doing that, so I'm sure eBay cracked down on them.

Many eBay photos are of stock items, and as much as it is in fact true that chickens aren't fungible, eBay may see them as just as fungible as one dollar bill to another, or one copy of the same DVD to another.

I'm sorry I can't really help, but you certainly helped me. I don't think I'll buy eggs on eBay unless the person says specifically the pictures are of their flock.

She will definitely have a case against this person, because her photo is her property, and he is using it without permission.

I would definitely report this! I've heard of other people having similar problems, and Ebay took care of the issue fairly quick.

Not on ebay, but I have a problem with a user on craigslist doing that in the Atlanta area. I've sent the message to all of the users here on BYC whose photos he uses. The sad part is, he has an ad in the breeder/hatchery section here, and BYC won't remove it, because he isn't using those photos HERE.
 
Well, the eggs he just had listed sold for $31. He doesn't actually claim that any of the pictures are his in the listing, and I asked him a couple of questions about it and received vague answers... "My lines are good bloodlines" "My birds show well".

I did report him to Ebay as using stolen pictures and defrauding buyers, but I don't think they're doing anything about it. I had a difficult time trying to find the right place to report him, maybe I did it wrong?

Alia, I would absolutely ask specific questions about the seller's birds before purchasing on Ebay. Better yet, buy them here where I think people have better birds to begin with and seem to be much more upstanding sellers.

So, Ebay didn't do anything about my report. And, he's relisted another dozen eggs. I believe this will be the 4th time he's sold eggs using my photo and another member's photo instead of his own. I guess it's time to email him...
 
This is one of the problems with posting pictures on the internet. Once they are are out here, you can't take them back and they no longer really belong to you. While I don't like what this seller is doing, I don't think that he/she's doing something that he can be accountable for. Sorry.
