HOA won't allow chickens

Hello everyone! This is my first post!

I have been wanting to get chickens for over a year now. My town's laws state that a household is allowed to have up to four hens. My neighborhood's HOA does not allow poultry. Is there anything I can do to try to get them to change this rule?

That's a shame...have you tried going to one of your HOA meetings and bring it up? Maybe you could guarantee them there will be no rooster crowing.....I dunno...just thinkin'.....

I've thought about attending a meeting or emailing them. Maybe I'll email first and then attend a meeting depending on the response I get. Thanks for your help! Sent from my iPhone using Tapatalk
 
If the rules disallow poultry, the board could change the rule if you are persuasive. However if the CC&Rs disallow poultry, you will have to get a large percentage of the members (typically either 2/3 or 3/4 of the membership) to agree with you to make a change to the CC&Rs. Even getting it brought to a vote would require either board approval or a fair percentage (typically 20-25%) of the membership signing a petition.

Just got shot down my the HOA president. Seems neighbors in our summer resort community who all live more than 150 yards away and maybe spend a month here total objected to my 8 pullets in a chicken tractor. The closest neighbors were all contacted beforehand and they were all alright with it. 'If you had them then others would do it to.' Since there are maybe 10 permanent residences in a subdivision of 140+ half acre lots. and only one within a city block full time cannot see the big deal. Just hope the market for vacation homes improves so I can get the heck out of Dodge. (If you kept them in the garage that would be OK.)" Not very any bugs or grass on the concrete floor in there. lol Next house will not be in a HOA!!! To change the CC&R's requires a 100% vote from the homeowners-fat chance from at least 8 of them.
 
So sorry for your outcome with the HOA. Sounds like there will be a 'for sale' sign going up soon on your place...best wishes and again so very sorry!!
 
But what if they are not enforcing all the CC&Rs, only the ones they feel need addressed? Rules such as no fences, no satellite dishes, all propane tanks must be fenced, although the local fire department and forest service do not want them fenced, no tin roofs yet almost all of us have metal roofing, (these rules were set up by the developers in the early 80's) are not being enforced. A three story house is being built that had to pass the architectural committee but is not allowed. My little chickens are not hurting anyone. An attorney on HOA law told me a year or so ago that as long as the chickens were not within 100 feet of someones' dwelling and there were not roosters there was little chance that a court would uphold that portion of the CC&Rs. Don't have the money to fight it, but it seems that the president of the HOA is picking his battles. Just angry!

It matters not..CC&R's are CC&R's..and the buyer of the property agreed to them..The board can enforce them or not...It isn't a democracy...Personally, I would never buy a house / condo in a HOA...If chickens are more important then the house / condo..sell it and buy where you can have chickens...My wifes parents owned a Condo and wanted us to go to a board meeting..It was a bunch whining people that want to dictate to other people...A bunch of sociopaths on the board. You couldn't pay me enough to live in a HOA...I value my freedom...
