Landlord demanding removal of chickens and ducks

Long, long story short I've been living here with ducks for about 3 years, and chickens for over a year. Recently (2 months ago) another renter's horses broke into my backyard (I live on a horse farm) from the paddock behind my yard and trashed it. This happened over and over again almost daily for over a month. I finally reacted by sending the landlord a note saying I was going to fix the fence myself (since no one else was taking responsibility for it) and take the costs including labor off the rent. I got no reply for a month, so I finally went and fixed it. Next I get a letter demanding that I remove all my birds (14 ducks, 25+ chickens) within 30 days, with no complaint or reason listed other than the birds aren't mentioned on the lease (the ducks were a verbal agreement and I just snuck the chickens in). I'm not about to get rid of my birds (other renters also have chickens and ducks, this is obviously a retaliation move) How do I legally tell him to go screw?

Hi :welcome

Sorry to hear your having problems with your landlord. I'm not sure I can be of much help to you as I am over in the UK. I would thoroughly check your tenancy/rental agreement really checking the small print. Would you be able to get some advice about this from a legal eagle? Over here we have a citizen advice beuro that helps with things like this.
It does seem a little pants that some one else's animal has caused the problem in the first place and then you are having the hassle. If other people have chickens and ducks it does seem that it's retaliation and very un fair.
Hope you get some answers and a resolution to your problem. Good luck.

First off...welcome to BYC!

Second...I hope you find a way of keeping your ducks and chickens and I think Yorkshire Coop has given you some good advice. But just in case things don't work out at your present locale, maybe it would be a good idea to start scouting out some place else for you & your birds.

Good luck!

Tenant laws vary from state to state, but in NY if your landlord has known about the pets and allowed you to keep them (even if in direct violation of lease) you get to keep the pets.

At least until the lease is up.

Landlord can, of course, choose not to renew lease.

(ie. Landlord can't after months of knowing that you have ducks all of a sudden say "you have to get rid of the ducks." EVEN IF the lease says "NO PETS.")

I'm in RI on a 38 acre horse farm where there's nothing about pets in the lease (everyone has cats, dogs, etc...). Lease is month to month, and I'm already looking for my own land, but that kinda takes awhile, could take years.

Basically, to resolve the problem of horses breaking into my backyard, the landlord's solution is to kick my animals out, take my backyard away, and give it to the horse people as part of the pasture they're renting. And I'm not about to let that happen.
