| Additional Information | Sec. 4-9. Keeping, harboring or owning poultry and rabbits. (a) No person shall keep, feed, raise or maintain any fowl or rabbits within the city limits, except as may otherwise be provided for herein: (1) This section does not pertain to household caged domestic birds such as finches, canaries, parakeets, etc. (2) It is acceptable to have seven (7) hens, three (3) turkeys, three (3) geese, seven (7) ducks, two (2) pea-hens, seven (7) adult rabbits, but no more than ten (10) of any combination of such animals may be kept upon any lot at least the size of six thousand six hundred (6,600) square feet. In the event that such fowl or rabbits are kept in a larger lot, the number so kept and maintained may be increased only in the ratio of the above figures to the increase in the square footage of such larger lot. (3) Parcels of land one (1) acre in size, and larger, excluding any area encumbered by structural improvements intended primarily for human occupancy, shall be governed by the following standards: a. One (1) to two (2) acres. One hundred (100) chickens, rabbits or ducks, fifty (50) geese or turkeys, thirty-five (35) peafowl per acre and no more than one hundred fifty (150) of any combination of such animals per acre. b. Two (2) to five (5) acres. One hundred fifty (150) chickens, rabbits or ducks, seventy-five (75) geese or turkeys, sixty (60) peafowl, and no more than two hundred twenty-five (225) of any combination of such animals per acre. c. Five (5) to ten (10) acres. Three hundred (300) chickens, rabbits or ducks, one hundred fifty (150) geese or turkeys, one hundred twenty (120) peafowl, and no more than four hundred fifty (450) of any combination of such animals per acre. d. Ten (10) or more acres. One thousand (1,000) chickens, rabbits or ducks, five hundred (500) geese or turkeys, three hundred fifty (350) peafowl, and no more than one thousand five hundred (1,500) of any combination of such animals per acre. (4) Up to ten (10) fowl and rabbits may be kept on a lot if they are in a pen at least twenty-five (25) feet from any residential dwelling or occupied building, except that of the owner of the fowl and rabbits. (5) Up to fifty (50) fowl and rabbits may be kept on a lot if they are in a pen at least five hundred (500) feet from any residential dwelling or occupied building except that of the owner of the fowl and rabbits. (6) No rooster or peacock may be kept upon a lot smaller than one (1) acre in size. Exception: Any person may maintain a maximum of two (2) hens on a lot smaller than four thousand nine hundred (4,900) square feet and closer than twenty-five (25) feet to any residential dwelling or occupied building for the purpose of fresh, unfertilized eggs, provided that such fowl do not violate the public nuisance ordinance and all requirements of subsection (b) are fulfilled. (b) Pen regulations. All fowl and rabbits will be restrained by a fence or cage of sufficient size and strength to maintain such, with adequate shelter from the elements of weather and predators. (1) No pen or cage may be maintained in such a fashion as to breed flies or emit offensive odors. (2) If a pen or cage contains less than or equal to ten (10) square feet of space for each fowl or rabbit, all manure must be removed from the pen or cage within twenty-four (24) hours and placed in a compost pile with sufficient organic matter that offensive odors are not present. (3) If a pen or cage contains more than ten (10) square feet of space for each fowl or rabbit, and is on natural ground, the owner may have the option to continually add mulch to the pen in sufficient quantity to eliminate offensive odors. This mulch may be in the form of bark mulch, wood chips, leaves, hay, straw, sawdust, etc. (4) All dead animals will be removed immediately and the owner is to contact animal control for proper disposal instructions. (5) All pens are to be kept in good working repair at all times; and the area surrounding pens are to be maintained so as not to become a nuisance to citizens of the city. (Ord. No. 09-E, § 2, 2-19-09) (d) All livestock must be kept at least twenty-five (25) feet from any residential dwelling or occupied building except that of the owner of the livestock. Sec. 4-11. Running at large prohibited. No owner or keeper of any animal shall permit or allow such animal to run at large within the limits of the city. All animals shall be controlled by leash, restriction within a fence, or by enclosure within a vehicle or container. (Ord. No. 09-E, § 2, 2-19-09) |
