| Additional Information | Spoke with a Goochland County Animal Control Officer, and he stated that the only ordinance on the books is no free ranging. However, as long as poultry does not encroach on a neighbor's property, there's no problem allowing them to free range on your own property. He also stated to check your HOA laws, because there may be restrictions in relation to your neighborhood. Here is the information found in the county ordinances: Sec. 3-126. - No-fence law adopted. The boundary line of each lot or tract of land in the county shall be a lawful fence as to any and all of the following animals: horses, mules, cattle, hogs, sheep or goats. Sec. 3-127. - Livestock must be enclosed on property of owner.(Ord. of 7-1-08(1), § 1) It shall be unlawful for any person to allow or permit any livestock or poultry or other fowl owned by him or her or under his or her control to stray to any highway, public property, or private premises of another. A violation of this section shall constitute a Class 2 misdemeanor. Sec. 3-128. - Compensation for livestock and poultry killed or injured by dogs.(Ord. of 7-1-08(1), § 1) (a) Any person who has any livestock or poultry killed or injured by any dog not his own shall be entitled to receive as compensation the fair market value of such livestock or poultry, not to exceed four hundred dollars ($400.00) per animal or ten dollars ($10.00) per fowl, provided that:(1) The claimant has furnished evidence within sixty (60) days of discovery of the quantity and value of the dead or injured livestock and the reasons the claimant believes that death or injury was caused by a dog;(2) The animal control officer or other officer shall have been notified of the incident within seventy-two (72) hours of its discovery; and(3) The claimant first has exhausted his legal remedies against the owner, if known, of the dog doing the damage for which compensation under this section is sought. Exhaustion shall mean a judgment against the owner of the dog upon which an execution has been returned unsatisfied.(b) Upon payment under this section, the board of supervisors shall be subrogated to the extent of compensation paid to the right of action to the owner of the livestock or poultry against the owner of the dog, and may enforce the subrogation in an appropriate action at law. |
