the one on the right has a pea comb, the other is normal, is that always the case
 
Can happen. Depends on the breeds used to get the EE. The one on the right I think is definately a roo.

thanks, yeah hes about 16 weeks or a little more now, I started to question him being a hen because the comb hasnt really grown and is still yellowish like his sister, my last rooster was polish and started crowing at 3 months on the day from hatch and was already super red in the face and comb. But I will say his sister has a more erect tail and his is a bit curvy.
 
At this age tail is of no concern. Color and comb size are the big factors. The one on the left is a pullet, right is a cockerel.
