Help I may have made a mistake!

sadly they do not want to give us our money back either. They would not even listen to a partial refund or anything of that sort. At this point on principle I'm considering taking them to small claims court it really isn't even about the money just the attitude they have displayed.

I realize this is honest too and we made a mistake and now we are paying for it.

I have to say that I would agree on small claims court. I have a problem with people that have an attitude about an error they caused. If I had made a mistake like that, I would be more than willing to correct it so I would expect someone else to do the same!! They should have covered their bases on finding out the sex before they advertised them as hens.
 
People who don't know what the sex of their chickens are shouldn't be selling them. That is false advertisement, at least they should have said not sure of sex. Hopefully they are truly clueless and weren't trying to sneak one over on you guys. Stinky situation you are in

I would say they knew exactly what they were selling you - roos - and that's why they won't take them back. Very unscrupulous sellers out there. Also beware of people selling you chickens as ones 'just starting to lay' when they are actually older and just about finished laying. Or sick/lice/mite infested chickens.
I was very new to chickens last January and was going to go the route of buying pullets at POL (point of lay) then after reading all the stories on BYC of people getting taken, I opted for getting chicks from a hatchery.
 
Boy.. what are the odds that you just happened to get 4 roosters? The seller was sooooo mistaken they were wrong on 4 of 4? You hate to think the worst of people but it looks to me like they "stuck" you with 4 Roo's on purpose. It might be worth just getting rid of 3 by giving them away and taking your lumps. Small claims court is a bunch of work for $60.

Just to clarify: You just bought these birds, at this age and looking like this and you were told they were females? If that is the case, its certainly not an honest mistake on the part of the seller. No way anyone who has had birds for any length of time would think they were hens. Its actually probably fraud if they did.

But, if you bought them when they were 6-8 weeks old or younger, it is possible to make a mistake with late maturing birds. the seller shoudl still make things right.

All that being said, around here, those birds would bring about $15.00 each at auction as roosters.

I think if it were me, and I bought them off craigslist or an ad somewhere, I'd take out my own ad, with pictures, and describe the situation, clearly naming the seller. Worst case scenario, you help someone else and keep them from being duped by an unethical seller, best case, they refund your money and ask you to call off the dogs.

Well now they are saying they won't take them back. Sigh it's our fault for not paying attention, but people should do what's right. Is it worth going to small claims court over 60 bucks?
I would throw a fit! Where are you located? I will go with you and demand they make it right. Don't let them get away with it!! You might want to keep the nicest and get 4 or 5 hens for him. The rest they need to either give you your money back or replace with hens. I wouldn't take no for an answer. Go Back to them. Maybe bring a few tall big guys with you

My wife bought them at this age. When I got home I knew right away. I think we are going to try and sell 3 and keep one.
