Somebody else beat me to my joke, so I will just get to the matter at hand. I would check with Agway and ask. If they say no, post him on Craigslist. I am sure you could either sell him for $5 or give him away. Chicks are hard to sex, and even the professionals aren't 100%, they are around 80-85% accurate. So, sometimes it happens. He is a pretty boy, so someone may want him to add to their out-of-town flock.

my sister will most likely take him so its not a total loss. still stinks though, he's one of our favorites and nowhere nearly as aggressive as half our hens

I don't think I can keep them if they are but I will try and see how they turn out. If anything I could let the female hatch some eggs so I could get a few females. I Have a farmer that lives across the street I might see if he could adopt them~ if they crow!! .

I have one that looks just like that from my Ameraucana Wheaten hen and a Ameraucana Silver Roo. I was on the fence as to pullet or cockerel until about an hour ago when he got separated from the flock and made a pathetic attempt to crow. To Craigslist he goes.....here's a picture of him. Anyone here from Northern CA interested in him. He is a sweetheart. Totally non aggressive, he just stand there for you to pick him up and love on him.

agway said they won't exchange the bird or refund my money but they'd be glad to take him and find him a new home. i would sell him on CL or eat him before i let them make more money off a bird that they sold me in the first place as a pullet. crazy. i think my sister will take him anyway so he'll have a good home with the 5 delkab amberlinks i gave her already this year.
 
another post had a girl who said her hen looks really similar to mine. is there anyway to tell for sure? i really want to keep this one
 
If you want to know for sure you can just keep him till he crows. I'd like to say 'or lays an egg' but sadly I think he's a roo too.
