Back on the 2nd of December, I walked in to my place of employment and was let go without warning or provocation.
I decided to file for Unemployment. The Sorry piece of poop I worked for Lied and I got denied. I filed an appeal for an in person hearing and am bringing my attorney.
As of this Sunday when I go online and claim my benefits, they will owe me about $4500 in benefits.
Being that Hubby's hours have now been cut and I have not been able to find a job this would be a phenomenal thing for us to win and get the benefits.
My attorney says I have about a 40% chance of winning, but I beleive in the power of prayer .
I am 46 and have worked pretty much steadily since I was 16. I have been laid off a couple times over the years and I never applied for UE until now.
Anyway, any prayers are appreciated. I will continue to appeal this if I get denied again, but I really hope they will decide in my favor this time and this will be over, although I doubt it cause he is enough of a jerk to appeal it too.

If you don't mind divulging some info...were you let go verbally or in writing as well? Have you asked your employer for a complete copy of your employment file? Feel free to PM me if you prefer answering that way.

Since you have worked from the age of 16 up till now and have never filed, you deserve it! I have been on both ends being an emplyee and employer. There are some who do take advantage of the system and that is not fair to people like you that has made an honest effort. I wish you the best of luck.

I was dismissed from employement without warning last September. My employer was really crappy about the dismissal and my supervisor, her manager and the store manager were surprising non-existent on the day I was called to the store manager's office by an assistant store manager (who sat in the meeting with her back to me, refused to speak to me and answer questions and said she was only a witness) and a guy I had never seen before in my 3 years of employment. The "normal" procedure on a firing is to for a store manager to personally escort the dismissed employee off store premises directly to the vehicle and visually observe the said vehicle exiting the premises. Funny thing, neither thing occurred to me and I was told I was welcome to continue to shop at the store. (For the record, I did nothing wrong to justify my dismissal - I violated nothing in the employee handbook - another employee with a higher status than me didn't like me)

It was a verbal dismissal with nothing in writing. I'm curious what makes the difference between a verbal and a written dismissal. Why do you need a copy of your personnel file?

I also filed for UE - my employer appealed and lost on the basis that my dismissal was unfair and unreasonable without specific documentation for their reason to dismiss me.

I am currently collecting my UE and in my favor is a really crappy job market right now. Nobody's hiring so it makes it much easier for my weekly filing information. What really sucks is that even the jobs I am applying for don't even acknowledge applications.

You have my deepest sympathy & full support. Employers need to be held accountable!

This was basically an owner of a small business and I was the only employee. He fired me verbally, there were never any write ups and honestly as far as I know, no employment file (he may have created one by now) His lies to the UE officer were that one the day before Thanksgiving I had several boxes of stock to put up (5 large boxes with multiple items per box) his labeling system was all by hand which meant I had to handwrite price labels. He left the store for a couple hours and came back, he got mad because I was not finished, he also saw that I had been on the computer (during my lunch break) also being on the computer was not forbidden.
So he told UE that I did not do as I was told and that was his reasoning for firing me. He also stated the reason he had not fired me before this was because he had to be away from the store.
I updated his website, helped him move the business took stuff to a Horse Show to sell on my time and never received any pay or compensation for this.
As far as the computer, the girl that worked there previously was always on the computer (MySpace, playing games etc) and she went back to work there after he fired me.
This guy never liked me from day one and I think he only hired me because he had an immediate need tohave someone there.
I have worked in sales and customer service all my life and honestly I think he felt intimidated. I also suspect but can in no way prove that he was carrying on with the previous employee, I am sure his wife would love to find out about that.
 
My heart goes out to you Karen. Sure hope that you'll prevail on Tuesday! These are such hard times we are in now. Hope your atty comes thru 4 ya!
