These were supposed to be Black Australorps... are they?

So we purchased some pure black Australorp eggs from an apparent 'breeder' who assured us they were indeed pure bred.... fast forward to hatching day and they have come out looking like this!
I know for a fact the breeder also had Marans (not sure what colour) which were apparently in a different yard, but the eggs we got were a light brown colour, not dark brown, so I assume they were laid by an Australorp.

Another chick has hatched since these two and it is pure jet black all over and has a different body shape. It's still in the incubator drying off so I can't get any pictures yet unfortunately, but I'm guessing that one is definitely Australorp.

So my question is, could these two possibly still be black Australorps or are they something else??

Thanks everyone, I had a feeling they definitely weren't. Needless to say I've sent the 'breeder' a very annoyed message as he told me he was meticulous with his eggs and they were definitely pure bred Australorps.
We have had issues with him from the start, we found out after purchasing that he had stored them in the fridge for a week :he And then out of the 36 eggs he sold us only 8 were fertile.... so needless to say we are extremely pissed off right now!

Lucky these little guys are so adorable, but we really wanted Australorps so looks like we'll have to try again with a different breeder. I will update this post with a photo once their feathers come in.
