What Breed am I??? Cockerel or Pullet???

Well I purchased some chicks and pullets recently and I know what most are since I purchased them as older pullets and some chicks. But the gentleman gave me a couple extra started chicks free of charge and we all know its hard to pass up free chickens. He told me that it was a Dominique but by looking at it closely I don't think it is since it has a straight comb. I am not sure on the exact age but it is smaller then the 12 week old Australorp Pullets i bought and larger then the 4-5 week old Welsummer chicks I purchased. Anyone have idea on breed and gender?

Oh, and willowbranchfarm, he said that he didn't know what age they are. They look about two months or so, I don't know. The top looks like a male, bottom a female. See the color difference?

The bottom chick is darker, but it has such a big comb! :/ The top is a cockerel though.
