Cleanliness and odors. City/Organization Contact name Additional Information Sec. 3-4. Fowl, poultry and livestock running at large. (a) It shall be unlawful for any person to allow or permit any fowl, poultry or livestock of any description, to stray to public property or private premises of another, and all fowl, poultry or livestock shall be sufficiently housed or fenced up by the owner or person exercising control over such fowl, poultry or livestock, so as to prevent such fowl, poultry or livestock from trespassing or straying. (b) It shall be unlawful for any person to permit any animal belonging to him or under his control, and known by him individually or by repute to be dangerous, mischievous or vicious, to go at large. Any animal at large in violation of this provision may be killed by any police officer upon the written order of the judge of the general district court. This section shall not be construed to apply to dogs. Sec. 3-7. Condition of stables, sheds, pens, etc. It shall be unlawful for any person owning, occupying and having use of any stable, shed, pen, stall or other place wherein animals or fowl of any kind are kept to permit such stable, shed, pen, stall or other place to become or remain filthy or unwholesome. (Code 1981, § 3-6) Sec. 3-8. Odors arising from the keeping of animals and fowl. (a) It shall be unlawful for any person to keep fowl, poultry, or animals within the town in such a manner or to such extent as to give rise to disagreeable or obnoxious odors and stenches, as well as the conditions, substances or other causes which give rise to the emission or generation of such odors and stenches, upon the public streets or upon any premises within the town. (b) Any person violating the provisions of this section shall be punished in the same manner as a Class 4 Misdemeanor as set forth in Title 18.2 of the Code of Virginia. Each day of violation of this section shall constitute a separate offense. (Code 1981, § 3-7; Ord. No. 2006-2, 3-14-2006) Sec. 3-9. Dead animals or fowl. It shall be unlawful for any person to throw any dead animal or fowl of any kind on vacant lots or anywhere within the town.
