Michigan Right to Farm Law, what does it mean?

I keep hearing this "if you want animals move statement." Two problems: 1. I did move and then the place I moved to changed the rules to outlaw animals. How many times do you expect someone to move? 2. Look around at cost of housing. The places with low housing cost almost without...

Michigan Right to Farm Law, what does it mean?

Keep in mind that RTF does not appear (there is some question if you can build after they refuse to grant it or if you have to litigate the permit first) to affect a local requirement that you get permits (planning/zoning/building/etc). So if your local government requires a planning permit to...

They have changes their GAAMP proposals and are trying to speed them thrgouh. While the language has changed the effect have not. "Category 4 Sites are locations that are primarily residential and do not allow agricultural uses by right and are not acceptable under the Siting GAAMPs for...

It appears to me that the delaying filing the final order deal is common practice. They know you cannot appeal until an order is filed so they keep you in limbo as long as possible. Are you still waiting on the appeal?

Michigan Right to Farm Law, what does it mean?

I hadn't noticed that before. Catagory 3. Anyone with more than 20 non-farm houses within half a mile no matter what the zoning will not be able to have animals!!!!!! (even if they are zoned for agriculture) That is pretty much every property in the entire state.

http://www.mlive.com/business/west-michigan/index.ssf/2013/12/farm_bureau_delegates_will_dis.html We have known for years that Michigan Farm Bureau does not support small farms, but now we are openly labeled as enemies.

Michigan Right to Farm Law, what does it mean?

If you are in a municipality like Shelby Charter Twp that has a history of harassing farmers and loosing it might be time to look at whether it is bad enough to consider a class action or group lawsuit for harassment. We have $600 already spent in filing fees, lost income from several days...

Michigan Right to Farm Law, what does it mean?

Tuesday narrowed our case down to a couple of issues. So we now have a business license appeal in which the city is claiming that no commercial farming is allowed so we cannot get a business license and a ticket for our goats in which they are claiming right to farm does not apply because we...

Michigan Right to Farm Law, what does it mean?

A published case from the court of appeals is binding on lower courts and on future court of appeals decisions. I found it when I went back to print out rtf cases for the motion hearing I have regarding our goats on Tuesday. As an attorney I have access to the casemaker legal research...

Michigan Right to Farm Law, what does it mean?

I have a copy of the Buchler case and it is almost entirely on point but it is a circuit court case not an appeals one so it is not binding on any other court. The important thing with this new case is that it lays out precisely what the standard for using mrtf as a defense so it is helpful no...

Michigan Right to Farm Law, what does it mean?

I had a reaction to store bought milk as well (migraines) and I do fine with our goats milk as well as with the un-homogonized organic stuff when we buy it. Eggs are a covered in hives, throat closes up, and can't breath kind of reaction so I doubt that a different type of raising would make a...

Michigan Right to Farm Law, what does it mean?

We had the goats for more than 7 months with no problem then suddenly one day they decided to make a fuss over it. We have a local ordinance that requires that you register your business before you sell anything and as an attorney (who has registered my business as such) there is no way I could...

Michigan Right to Farm Law, what does it mean?

No chickens, I am allergic to eggs so they would not do me a whole lot of good. Muskegon also has a local ordinance that allows multiple goats but only one chicken so it would require a court fight under right to farm - I was kind of hoping they would follow their own ordinance and we would not...
