That is the norm when there is a legal dispute, and technically if they have initiated legal action as you imply you should only be contacting their legal council not them...
Probably nothing as most small communities, HoA and subdivisions (at least in my area) pay a local lawyer a flat pre-paid yearly fee to handle all these types of disputes that come up... That or they purchase an insurance rider to cover it... In the end it's you and your neighbors paying their legal bills for them anyway with your association fees and/or taxes...
