some will say cruel, but if it's your birds or a predator,you do what you have to do. If there is no danger to domestics or people then in a situation like this I would set up a couple leg snap traps right around the perimeter of the pen. Disguise them a bit by digging a little dirt away and set them down in the shallow dug out bowl. Cover with a little grass or leaves. You will get him in a day if you do this. Only do this when you know you have an immediate problem visitor and you will be around to monitor.
