Speckled sussex, are these both pullets?

I have 2 12 week old speckled sussex I got from meyer hatchery, and although they seems to have the same comb and same friendly personality one has a tail thst makes me think rooster.

The first picture is the one I'm pretty certain is a hen

And here are some shots of the other one

Local laws and regard for the sanity of my neighbors say no roosters but I'd hate to lose my friendliest chicken.
