Is this a she or he and what breed?

I'm thinking this is a male, but I'm not sure of the breed.

This is not the best picture, but it looks like she has the beginning of a crest on her head. Judging from that and the color I would say that he/she is a silver laced polish, or a mottled Houdan. The easy way to tell between these two is if the bird has a fifth toe. Houdan's are one of the few breeds that have 5 toes on each foot. Polish, on the other hand, do not. Anyways that's my opinion. Let me know if I'm right

Yes the bottom picture looks like a Frizzle. Also the chicken in question (the first picture) has 4 toes you forgot to count the one in the back.
