Makes sense to me. I live in rural Texas and don't have to deal with ordinances (thankfully). I would guess noise is usually a main issue, and bantams are quieter, so maybe use that in your argument? I really don't know, but I wanted to give you a bump so those who've dealt with these ordinances...
