I'm sure it wasn't a gyrofalcon since it wasn't spinning.
I wish I'd gotten a photo of it. It is difficult to remember details like the shape of the tail. I think it might have been a juvenile Merlin. It's really difficult to find good photos of the juveniles. It might have been a juvenile Sharp Shinned, but it was solid looking, so probably a Merlin.
Too small at any rate to attempt a 9 pound duck, which is the smallest domestic thing in the orchard. No babies this time of year and I never put the peeps out until they have good size, so they are in no danger.
I never condemn a predator until he actually takes on the livestock. These small hawks haven't given me any problems and they are welcome to all the sparrows they can catch.
