ARTICLE 4 Rabbits and Fowl
6:2-28. "FOWL" DEFINED.
As used in this Article:
Fowl shall mean pigeons, chickens, ducks, geese or other fowl.

6:2-29. COMPLIANCE WITH ORDINANCES.
No rabbits or fowl shall be kept within the City except in accordance with the requirements of this Article. (R.O. 1966 § 6:2-20)
6:2-30. PERMIT REQUIRED; DURATION.
A permit shall be required for the keeping of rabbits or fowl in the City. The permit shall be obtained from the Director of the Department of Health and Community Wellness, and shall expire annually on December 31. (R.O. 1966 § 6:2-21; Ord. 6 S+FE, 10-17-07; Ord. 6PSF-E, 8-6-14)
6:2-31. PERMIT FEE.
The fee for a permit under this Article shall be ten ($10.00) dollars. (R.O. 1966 § 6:2-22)
6:2-32. REVOCATION OF PERMIT.
Permits under this Article shall be subject to revocation, after notice and hearing by the Director of the Department of Health and Community Wellness for cause. (R.O. 1966 § 6:2-23; Ord. 6 S+FE, 10-17-07; Ord. 6PSF-E, 8-6-14)
6:2-33. KEEPING FOWL IN DWELLING PLACES PROHIBITED.
Under no conditions shall any rabbits or fowl be kept or maintained in multi-family houses or multi-family house yards, or in any dwelling house, or in any part thereof. (R.O. 1966 § 6:2-24)
6:2-34. RUNNING AT LARGE PROHIBITED; COOPS OR HOUSES REQUIRED.
No fowl or rabbits shall be allowed, under any circumstances, to run at large. They shall be kept confined in a suitable house or coop with an enclosed runway. (R.O. 1966 § 6:2-25)
6:2-35. SPECIFICATIONS FOR COOPS AND RUNWAYS; SANITATION.
a. The house or coop referred to in the preceding section shall be floored with cement or other watertight flooring. The runway shall not be floored.
b. Such house or coop must be kept thoroughly clean at all times. It shall be cleaned at least once in every week, and more often if the Health Officer shall so require.
c. No part of such house, coop or runway shall be less than twenty (20) feet from the doors or windows of any premises occupied by human beings, whether for dwelling or business purposes.

6:2-36. ROOSTERS PROHIBITED.
It shall be unlawful for any person to keep or maintain roosters within the City. (R.O. 1966 § 6:2-27)
6:2-37. PENALTIES.
Anyone found in violation of this chapter shall, upon conviction of violating this chapter, be fined in an amount of at least one hundred ($100.00) dollars, but not to exceed one thousand ($1,000.00) dollars and/or may be required by the Court to perform up to ninety (90) days of Community Service and/or may be required to serve thirty (30) days in the Essex County Prison.
