Update: he did answer and is saying he thinks it is a hen but is going to swap it out for me just in case lol

Hi
I'm new to chickens and bought 3 rhode island reds. The seller assured they were all laying eggs. Well that can't be true because one is now clearly a rooster. Would it be wrong to ask him to give me a hen for free? I paid for 3 hens. But he's not answering messages now. Obviously if he hadn't specifically said they were all laying it would have been my own risk but he did..
Thanks!

How old are they supposed to be? How long have you had them?

If he's been avoiding you then it seems he unloaded an unwanted rooster. Unless he's on vacation or something.
He said all 3 had just started laying, so they're young , I've had them for 1 week and the rooster started crowing today. He assured me multiple times it was a hen even though the comb was a bit bigger. I got duped didn't I 🤦🏼‍♀️

That being said, is asking for a free hen reasonable?

Not unreasonable at all. Can you upload a pic of your rooster? Some hens crow...
The tail feathers were not this prominent when I got him

Well then I'd give him the benefit of a doubt and figure he didn't know it was a roo.

And, some hens do crow if there is no rooster around to do the job.

If he's a decent person and has an extra pullet it's not unreasonable to ask for another girl.

Thank you! I was nice in my asking in case he truly thought it had laid eggs

If you purchased three hens, and he assured you that all 3 were laying, asking for him to give you what you paid for is not at all unreasonable. You aren't asking for a free hen, you are asking for what you paid for. (Now, if the seller doesn't want to give you another pullet without you returning or paying for the cockerel that seems okay on their part, but if you asked about the cockerel and he assured you it was laying eggs that's just you asking what you paid for)

mistakes happen sometimes. Maybe they bought sexed pullets from a hatchery to raise to POL and sell and they don't have a lot of experience with recognizing cockerels. Maybe they were distracted and didn't actually pay attention to which birds they were giving you. You said the cockerel just started crowing today, so maybe they just haven't seen your messages yet. If they were being honest and just made a mistake they should be trying to make it right by exchanging the male for a female or refunding your money.

I'd give it about a day and a half, and if they haven't responded to your messages by then I'd say you got scammed.
