I live in the town limits of Chesterfield S.C. I have had chickens on this property since 1959. My father and I began raising chickens when I was 5 years old. There have been gaps where there were no chickens, but now, since I have moved back to the property permanently, The Town of Chesterfield passed a restrictive chicken ordinance. I came before the town council prior to them passing the ordinance. I informed them that I had 25 chickens, and wanted to be Grandfathered in regarding the ordinance. Well, they passed the ordiance and left me out totally. I have one rooster and 24 hens. I am looking at the legal aspect of my situation, but need to do something. The attorney I talked with, suggested that I should have my case heard before a magistrate. He stated to me that going to court on a higher level would be very costly. I am looking for any help with my situation. Thanks [email protected]

Speak with a lawyer for sure - they cannot change an ordinance and force you to abide by it. You should be grandfathered in. Take steps to find ways to prove you had hens before that date. Anything in writing.

Best of luck.
