hernando county fl chicken permit question

Hi everyone, I just went and submitted my personal back yard chicken permit to my county and have a question that the permit lady was unsure about. according to the informatin for the permit it says: "The chicken coop shall be kept in the rear yard and must not be visible from adjoining properties or the street. Fence construction shall meet standards pursuant to the fence ordinance and shall be permitted separately. The chicken coop shall be situated a minimum of 25 feet from the nearest neighbor's residence and at least 5 feet from all property lines." My coop is set in the back corner of my property and is 7 feet from my neighbors yard and 8 feet from the back property line..however the back property line has a 10ft easement as its along powerlines. So she thought that that meant it must be OFF the easement and must be 10ft into my property. its not a huge deal but I have my coop totally rat proof were it sits now and moving its a pain..even 2 feet over as I would need to dig up the wire mesh i burred under the coop to prevent rats. So has anyone in my neck of the woods gotten their permit and had their coop inward on an easement?

I havent had to deal with ordinances (i live a few miles outside city limits) but unless they come to your property and check, which they dont do anything of the sort in the city here, they just trust you to follow the law and here you dont even need a permit.. just no roosters and 6 hens max.. then Id say you'll be fine.. I highly doubt the powerline workers would give a rats butt if you had a coop on the easement lol. Thats just my 2 cents from Tennersee 🤟🤟

I wish it was that simple here. No they charge $100 for 5 yrs and u can only have 4 hens.theh do a site inspection and there are a bunch of rules.i read them all but the very nice lady who did my paperwork with me was just not sure about tje easement part.

Ohh man, thats intense! I have a feeling she's probably right, best of luck figuting it out! If they make you move it, come on up to Tennessee, were practically lawless 😂
 
Nope. Your property line is your property line. The easement means only that the power company has a right to use that portion of your property it if desired - most likely overhead, but potentially underground. and if they choose to exercise that right, its superior to your own - so you might need to move (or remove) your coop under those conditions, at your own expense.

If they wanted it setoff from any easements, they could have written the ordinance that way. They didn't.
 
The power company's easement is for unimpeded access purpose to maintain the system. Has nothing to do with the poultry ordinance. You are allowed to build structures like sheds and coops on easements.
