Hey! Me Too!

Here I am living in the country on my own property and after 3+ years I am suddenly told I can not raise my birds. What is going on with the bored people out there? Yeah we are all in a depressed finantial state but what the heck! I am having to rezone my property back to the zoning ordinance that it was orriginally at when I bought my home in 2002. It is costing me a small fortune for a person that is unemployed. I love my birds and maybe this is carrying it a little too far, but I am following through with it. It's the only way I know to save my flock. Good luck to all!!!

When it was re-zoned were you given notification about the change and offered the opportunity to give your opinion? It seems like your birds would be protected by grandfathering, even if the zoning did change.

That depends upon what the old zoning ordinances had to say.

Some uses expire if not continuously maintained.

The grandfathering clauses frequently make current nonconforming uses valid only if there is no break in use from the prior zoning ordinance. Some allow a specified length of time that a use may be discontinued and then restarted.

If there have been many ordinance changes and someone has owned a piece of property for a long while it can be a nightmare to completely determine what they can do on their land.

True, but the OP stated that she has owned the property for 8 years, and that she has owned chickens the last 3+.

On re-reading the original post, I have a question--was the zoning for your property changed, or was the zoning ordinance changed? And when?
