Rant. We were sold a dock that is apparently not ours!

What if you and the neighbors just share the dock? How many boats do you guys have?

You are not going to like this, but it is not up the the realtor to know all about the property. It is up to the buyer to research and find out what is included and never rely on the realtor who may have been given misinformation by the seller. Did you have a survey?

In many states it is and they must get disclosures signed by the seller on all this stuff. Your title insurance may also come in to play on this.​
 
Yes, disclosures filled out by the seller, not the realtor. I was a realtor for 8 years and anything that is public record is up to the buyer to confirm. There may be slight differences in state laws, but ultimately, it is up to the buyer to find these things out before the purchase. I'm not talking about someone lying about the facts knowingly, but just passing on wrong information from the seller.

All that said, I do hope you can satisfactorily resolve this one.

F&G claimed that the they wrongly issued a permit for a dock 15+ years ago and now they have realized their mistake...and yet, although they can allow the neighbor to permit the dock as theirs, they can't pronounce who owns the dock.

I'm not sure what to think of the neighbors. It seems strange that they bought their house all those years ago without mention being made of the dock being included and didn't bother the owners of the house before we got here. It was only after we moved here that they came over, asked us about the dock, found out that we didn't know the history, and told us that they thought it might be theirs. I think it is strange, too, that they never used the dock until after the F&G guy came out, and now they are out on it a lot. So far we have all remained friendly and civil but I feel like they are using F&G's ambivalent polices to steal from us...I mean, we paid for the dock, they didn't.

I don't know what to do. I'm still waiting to talk to my in-laws. The more I think about it, the angrier I get. The neighbors have been out clearing out around the dock all day. I just want to throw something at 'em! (I won't, of course).
