I think this is a male House Finch? He is very flighty when I go to pick him up, but cannot fly very well which makes me guess it is a fledgeling. In the pictures he doesn't have tailfeathers because they were ripped off by a feral cat. I rescued him from the cat and took him in and he is now living in a little pet kennel. He LOVES strawberries and has become a little tame because he now eats them from my hand without flying off. My little sister named him "Mr. Figgleywinks" so I just call him "Figgy."
He still tries to fly when I pick him up, like in the second photo, but other than that he does not spook when I have my hand in the cage.
Isn't he cute?
I also called the feedstore that carries finches and they said if I hand feed him fruit he should be fine. I may take him over there today so they can have a looksie at him just incase.
