what is this

I know it is a crappy picture, but the best I could do at the moment. I've seen it fly over, but never where I can get a good look at it and then it lands in this dead tree at the neighbors

Thanks - it appears to be what I see flocks of flying by and sure, that guy up on the tree could be that.
