18 week old RIR - Pullet or Rooster?

We aren't allowed to have roosters in our city, I'm afraid we got one, would like to confirm with the experts on here. He/she is an 18 week old Rhode Island Red. If it is a rooster, anyone in Orange County, CA want him?

Here is another picture where the tail feathers are a little easier to see. I think there are thin pointed feathers near the base.

Another thing to note is that the last few mornings she/he has been pretty noisy, but it doesn't sound like a "cock-a-doodle-do" so I'm not sure if she is getting ready to start laying or if he is practicing crowing.

Pretty sure you have a roo there, especially with those pointy saddle feathers.
 
That is most definitely a cockerel.
He's even starting to get in his green rooster tail feathers.

Looks just like mine did when he was younger.
No hope of eggs from this one.
