Anyone have rules that require Coop and covered run?

Anybody live with rules that require you to have a secure coop and covered run built for your chickens? How would something like this be worded?

I am trying to write an amendment to our covenents to allow homeowners to have a small backyard flock. The concern most of the neighbors that I have talked to is that the one lousy homeowner in the subdivision would get chickens and create problems (smell, mess, eyesore, ...). In an attempt to limit who gets chickens to those who would take care of them, I am going to propose that the covenents require a secure coop and covered run be built in order to have chickens. This structure would also need to be approved by the architecture committee - accessory buildings are already covered by the covenants - but they are not very picky, mainly looking at location and structure so that it sorta matches the other buildings on the individual lots.

Yeah, I addmit that we are a little snobby, but there are no trees in the area and we all have to look at everyone elses yard. Everyone gets along fairly well, except for lousy neighbor (other nick-names withheld to protect the sensibilities of the reader)

With the number of hawks, eagles, coyotes, fox, badger, and dogs at large (only 2 at this time), I also think having a secure-covered run is neccessary to anyone with chickens out here on the prairie. Even without anyone having "prey" as pets, we have hawks and eagles sitting on fence posts all the time. I'm taking like everyday you can spot at least one in the subdivision. One of the neighbors won't let her little dogs (King Cavalier Spanials) out without being with them because she had a golden eagle circling the yard one day and "eyeing them up for lunch".

I have the impression, that without significant restrictions included, an ammendment to allow chickens would not be passed.

A. As provided in § 3.1-796.94:1, § 18.2-121.1, and Article 5, No-Fence Law, of Title 55 of the Code of Virginia, animals and fowl running at large shall be prohibited. Any person violating any provision of this section shall receive a warning from the Frederick County Sheriff's Department for the initial violation. Any subsequent violation shall be punishable by a Class 4 misdemeanor.
B. Division fences shall be established in the County as provided in County ordinances adopted 12-22-1888, 7-19-1919, 12-18-1922, 11-7-1924, 3-30-1930, and 5-10-1948, which ordinances are on file in the County offices. Responsibility for construction, maintenance, and repair of such division fences shall be as provided in Article 6 of Title 55 of the Code of Virginia.


This is all my ordinance says, but it might help you with your wording. I cant find article 6 of title 55 to get you more detail. Hope this helps.
 
My township also has strict laws on fowl running loose. We are not allowed to keep more than 20 chickens, no roos at all. The law states that they shall be kept on the property and not allowed to run loose. To be honest, with the fox, hawks etc. I wouldn't even think to have them in an unsafe environment. A locked coop and covered secure run is what they have.

The run/coop size would depend on how many chickens some one has. I guess you could say the maximum size it could be. I have a covered run just because I read the predator post so much when I first got chickens and scared myself. I think you could word the ordinance in such a way that states to keep chickens the run must be covered I have seen so many different style of runs some that have a part from the coop that looks like the covering from a porch others just cover the run with wire and have a tarp over it for shade. We don't have any rules about the pen just that the coop has to be 50 feet away from where our neighbor lives. Our ordinance does not even cover a pen. Just that you could be charged with animal at large (they use this for dogs since cats don't have to be leashed). I think you would could end up wording the ordinance in such a way that it is almost impossible to keep chickens unless you have some one draw up a approved coop/pen design and that is the only one that can be used they can change the dimension if they need it smaller for less chickens. We live in the high mountain desert ecosystem, at around 7400 feet. We get an average of 15" of precipitation per year.

Here is a view of our neighborhood. All the lots are between 8 and 12.5 acres.
