A BILL FOR AN ACT
Relating to the inbreeding of dogs.
Be It Enacted by the People of the State of Oregon:
SECTION 1. (1) As used in this section:
(a) Breeder means:
(A) A person registered as a breeder of dogs with a kennel club, breed promotion organization,
breeder referral service or other entity organized for the purpose of providing credentials,
advertising or contact information for breeders of dogs; or
(B) A person that has, within 12 months prior to breeding a pair of dogs kept by the
person, sold or advertised for sale more than two litters produced by dogs kept by the person.
(b) Dog means the species Canis familiaris.
(c) Kept means owned, possessed, controlled by or in the charge of.
(2) A breeder may not breed a dog with another that shares a common parent or
grandparent with the dog.
(3) A breeder shall keep a record of all puppies produced by dogs kept by the breeder.
The records shall include identifying information for the parents and grandparents of the
puppies. This subsection does not require a breeder to maintain a record for stillborn
puppies. If the breeder possesses or can obtain information identifying the parents or
grandparents of dogs that the breeder uses for breeding, the breeder shall maintain a record
identifying the parentage and grandparentage of the dogs used for breeding.
(4) A person that breeds a dog in violation of subsection (2) of this section:
(a) Commits a Class B violation for a first offense; and
(b) Commits a Class A violation for a second or subsequent offense.
(5) A person that fails to maintain records as required by subsection (3) of this section
commits a Class A violation.
SECTION 2. Section 1 of this 2009 Act applies to dogs bred on or after the effective date
of this 2009 Act and to puppies born 60 or more days after the effective date of this 2009 Act.
