Five weeks old. The pullet in the back is a partridge Plymouth rock. Same age. From a hatchery..... Did we get unlucky??

It looks to be a rooster.

with those dark legs, that back bird shouldn't be a Rock of any color...I'd guess clean faced Easter egger. What kind of comb does she have?
 
The brown one in the back is a hatchery partridge plymouth rock. I don't know if she is or isn't, but she sure looks like pictures of them I see in search results. Also 5 weeks. No comb showing on her yet. Why do you think she isn't a partridge?

That's why. I'm not saying she's not partridge color, I'm saying she doesn't look like a Plymouth Rock. Rocks should have yellow legs....black Rocks might be able to have dark legs like this, but not partridge. She could be just poor quality hatchery stock or she could be another breed. A close up pic of her comb could help determine, or you can just wait until she matures and lays an egg and see what color you get

Will be interesting to see! With all the crappy hatchery identifications, I can't believe there are still purebred chickens left. :p I have a "RIR" that looks just my production red chicken. That production red was sold as a buff check. Hah!
 
I agree with the above comments that he's a roo. I'm only really familiar with Orpingtons though, and seeing his yellow legs tells me he's not an Orp. Is he a buff rock?
