Jail time is just part of what is written in the legal code as the MAX punishment for a misdemeanor. It's not an appropriate punishment for all misdemeanors and, honestly, how often does ANY criminal get the max sentence?
This woman knowingly let her dogs roam the neighborhood, despite being told many times that her dogs were causing problems. The dogs were in the pen, chasing the birds around, one of the birds died. Dog could have jumped on it, bird could have broken its neck crashing into the fence, maybe the bird just died because it was panicked and flailing around in the heat.
Then the man called his neighbor about her dogs. She laughed at him and when he became upset she hung up on him. Later she offered him $30. She still didn't take the matter seriously since she STILL thinks that the idea of her dogs killing his chickens is funny and that his chickens aren't worth being upset about it. I would have told her to shove her cash where the sun doesn't shine.
She is going to court because, instead of being a good dog owner, she left her dogs free to roam and get into trouble. Instead of being a decent human being and apologizing to the man, she thought it was funny that he was upset. Instead of going to court and being remorseful to the judge, she still thought the whole thing was stupid and a joke.
Notice who the ONLY person in the scenario who doesn't take it seriously? A little bit of human compassion would have gone a long way. The judge's own words were that she wasn't taking the matter seriously and he wanted her to understand exactly what she was being charged with. Now, there are 2 options. 1) there is a giant conspiracy in the state of MO to pick on sweet gentle ladies who own little dogs or 2) this woman is acting in a manner that is breaking the law and mocking the charges against her because she feels that the law doesn't apply to her.
