Cockerel, breed?

My local pet store has this chicken they are trying to give away. We have 8 chickens now and I want to rescue this poor lonely chicken. The only catch, my local ordinance doesn’t allow roosters. Does anyone know if this is a pulley or cockerel? Is it a Sussex? Any help would be greatly appreciated.
