Confused...what does this law mean? How would you interpert this?

I was told from someone from the board I needed to fill out a form and get a variance like you said and them go to a meeting to explain my reasons

The defination the site for a dwellng is this:
"DWELLING
A building designed or used as the living quarters for one or more families. The term "dwelling" shall include seasonal homes and mobile homes provided that they meet all the requirements of this chapter, the building code, and all other regulations or ordinances applicable to dwellings.".

So I wonder if that matters being a coop isn't my house going accoording to the defination of what is considered a dewlling? I would think a coop should be considered the pets dewlling like you said though right?

That was going to be my post is that their definition of "dwelling" is human housing, does not include barns, coops, or other outbuildings. So that is not your loophole unless your going to keep them all in your house!

You have two choices. You can either present your request at the next meeting in hope that they will grant permission. If they do your in the clear. Or, you can just be quiet, lay low and try doing it all "under the radar". Though if there is a problem with any neighbor's you'll be back at square one either trying to get permisssion or having to get rid of your birds.

I also would not even discuss a rooster with them at this point! That is probably the fastest way to get your request thrown out or, if you keep chickens illegally, to get complaints from neighbors right away. Also do not discuss this with neighbor's first. Your not likely to get approved at all if any of them pitch a fit over the idea.

I'd go to the meeting, present my case re keeping a few hens compared to a horse or cow and go from there. The woman who has spoken to your real estate agent is simply quoting the law as it reads on the books so that info is of no help to you.

it sounds like you are going to need to find a bigger lot if you want chickens or tell them no deal if you cant have the chickens

I can't get a bigger lot at this point I'm way to close to getting this house finacially and legally I've tied my hands up with this house I can't just walk away and look for a diffrent house at this point because I'm closing on June 30th as long as nothing holds it up and all goes well. What I should've done was checked out the towns of the houses I was looking at and asked if they allowed chickens there, but too late for that. I'd be crazy to just walk way from this house just to get chickens.

Ugh, what a pain. I just found this post, I was going to say don't say anything and fight it later. But they already know who you are...bummer. I would guess someone has bigger fish to fry than to make you get rid of a few chickens, but of course you don't know for sure. Needing 3 acres to have a few chickens is RIDICULOUS. We have an acre and a half and they take up such a small percentage of the land and bother no one.

Thanks, you have very good ideas! Yeah, I was disapointed when I read their defination of a dwelling was a home for humans

. I do have a shed already on the property wonder if I can legally build onto that into a coop lol? I probaly can't use that as a legal loop hole either my guess is....*sighs* I'm just trying to find any loop hole possible at this point. I agree if I leave it up to the neighbors my luck they will be anti-chicken. Yeah no roo for me only hens wil be my best bet since I want to avoid being found out about if I decide to do this all stealth "under the radar". As for the meeting I'd be willing to go, but then there's the fear they'd say no and then I'd be even more on their radar and if I decided to go ahead anyway and do it they'd come after me. Really this is an unfair law that we need to have 3 acres to have chickens! As you even said if I go to the meeting I should point out that they allow a horse or a cow which are nosier, more smell, bigger etc than having 5 hens and if I decide to get Bantam chicken will be even less space they take up. I know if I was the one writting up these laws I would have 3 acres for a cow or horse and at least 1/4 acre for chicken and have like 30 chickens per 1 acre as a law. So people w/ 1/2 acre would have 15 chciken limit and 1/4 acres would have about 8 (since 7.5 would be 1/2 and you can't go halfs on an animal lol). I think that'd totally be more fair ya know?

. Anyways was saying yeah it's ridiculous that you need 3 acres for chickens. I only want like 5 chickens not a whole army lol! I wish I hadn't called and gave them my info when I was inquiring about the laws and regs regarding chicken ownership. I sure hope they won't hassel me if I get the chickens at this point I've gotten so intrested in doing this idk how I'd handle going up to the board meeting and being told no....I want to do the right thing and follow the laws, but really it makes no sense someone can have a horse or a cow on 1 acre, but not a few chickens. Whoever wrote these laws must have been on something lol. If I do do it under the radar thinking need a coop that doesn't look like a tradtional coop lol.

Illegal chickens rock!

too funny !!!

Do you have a close relationship with your Dr. ? Go tohim/her, explain the situation, have them order some kind of theray, refer you to a cool counselor
and recommend you get therapy birds !! I know people who have done it with dogs, why not chickens ?

What happened to the good old days when you could have any animal you wanted or building or dwelling ! Now they can tell you how many or what kind or
whatever is crap

I would say wait until Spring until they forget about you. Chances are there is alot going on everyhwere else and it will have been forgotten.
Build a small , CHEAP coop out of recycled materials, so if you are forced to get rid of them later, you are not out alot of $$. Build a fence around it, or put it somewhere not visible from the road. Plant something tall around it, the fencing so it is camoflauged. I know you wouldnt be able to see it, but maybe a prvacy fence by part of it to disguise it.
Dont get a rooster.
Find out who the mayor is and get chummy with them .
