Cops

I don't much care what some overpaid and underworked pansy declares as legal or illegal, if a dog threatens my livestock, it's history. I might not pose for pics with it and publish it, but I'll definitely not shy from shooting it.
 
Lacy 1988,I have one rent house 200 yards to my South.
Over the last eight years I have been more than fair.When
renters dog(s) get loose and terrorize my 35-75 free rngrs
I collect the dog when possible and my dearly departed .
Then I confront the owner(s) and ask them to upgrade to
a chain or run that cost more than five bucks at Walmt
and I ask politely to replace my stock. Not one time did
ANY of the 4or 5 tenants make good on their word !!!!
I keep a dog ,used to be a bunch more as I did hoghunt
often. I also bred catch dogs and pet Bullys. IT was very
rare my dogs got loose,99/100 times they'd kill my birds
by the dozen,I'd always give my son the option beat 'em
or blast em? There's no reform that I've seen work, EVER.
Back to tenants I'D return the dog and or the carcasses.
If they had kids and fluffy was the family pet,maybe some
slack was cut. I dont enjoy shooting dogs but there's a pt
when crossed you have to and legally can protect your
critters and any judge anywhere will most likely find in
your favor. Be sure and take pictures and get statements
from ALL witnesses who can positively identify the dog !!!

Sounds like you've been very patient & more than fair over the years. Unfortunately, every time a new renter moves in it's like starting from square one. Must be a bit frustrating.
 
His kitten is a domestic animal. And as far as putting it down after the fact he did so immediately upon finding the creature suffering. He is within his rights 100%. My only thought was to try to put it down with the 1st shot when ever possible. You did right not letting it suffer more tho, don't get me wrong. You're also right about eventually getting to your chickens.
I am in Louisiana, its legal here too. Always protect your own tho on your own land...sss as a last resort.

I have dogs. I am responsible for them 100%. If they can't be attentive to their creatures and control them they don't need dogs, or other living creatures.

A couple potential problems:

1) Your kitten isn't considered poultry or livestock. Fortunately, your state has a separate statute allowing the use of force to protect pets.
2) You shot at the dog after you scared it into dropping the kitten. The right to use force typically ends when the threat ceases. You could end up trying to convince a judge or jury that you were reasonable in your belief that the dog was still a threat.
3) You euthanized the dog. Most state animal cruelty law specifically authorize only police, the SPCA, animal control, and veterinarians to euthanize an animal.


Mississippi's statute is the first I've seen that allows ordinary citizens to put down an animal.

What you did appears legal in Mississippi but is not legal in all states.

Thing about it is these people have been warned before. They used to have to large pit bulls that came up here almost every night. I told them about their dogs they ignored me well they got in my pen and killed two hens and thirteen bittys sooo yeah one got shot. Did not kill it though.

You know some people only draw breath because it's illegal to remove !

Hard to figure some people's thought process alright. Some of em, if they're not wearing a hat their head would be of no use at all. Maybe you should try taking a bottle of wine over when the next one moves in as a house warming gift & drop a subtle hint. Couple bucks, might ward off some trouble down the road.
 
Yes, I definitely think you did the right thing. My next door neighbor had Akitas (I think that's how you spell it) that would eat the cats. Being a cat lady I totally understand. If they really cared about the dog it would not have been out at night. I think people are sensitive about animals such as dogs and cats being killed because they think of them as their domesticated pet. Also I know some people kill these animals for no reason. For example, after showing my favorite outdoor cat to my cousin who lives behind us every morning and always talking about the cat and how much I loved him, he sees the cat in our back yard one day and shoots him in the neck while he's lying down so he suffered before finally dying. My cousin tossed the body in the weeds and then posts a picture on a social networking site where he knows I followed him. That is no way to discover that your pet has passed: to see the gory picture all over the internet and have him tell every one how it was diseased and injured and he put it out of it's misery and then to see our friends commend him for such a good shot. It was sickening. I really miss my Tiny Tim and I had just held him an hour before he met his horrible fate. We couldn't even press charges because my Mother's sister had custody and she would have been the one to get in trouble. I'm a hunter myself and I even shoot groundhogs with my dad when they get into the garden or chew the wires of the junk cars, but I could never kill a pet in cold blood like he did. besides the cat wasn't even on his property and the cat was not trying to injure one of his own animals. Perhaps your neighbors don't understand what the dog was trying to do to a poor, defenseless baby or perhaps they never even really loved the dog and can't understand why you would try so hard to save the life of your own animals, kittens or chickens. I'm glad the police understood the position you were in. I hope things get better between you and your neighbors as I know things can get pretty difficult when you have to live around people (such as my neighbors) with such little respect for the life of an animal.
