Simple. A thermos does nothing other than try to prevent the entry or exit of energy... thus hot things stay warm because not much energy can leave, and cold things stay cold because heat from the environment has a hard time getting in.

I see the whole drunk-driver vs. cop thing as typically inane. Here, they wait til you start your car moving - so they can bust you. Police are the strong arm of the ruling system. They aren't as concerned with ethics, as they are with enforcement. They are all about deterrent via threat, or clean-up when people lose control. I suspect the police themselves would prefer everyone be self-disciplined automatons, so they wouldn't have to work so hard. Personally, I reckon drunk drivers should be stopped at the source - the bar.
Along these lines, here's a blooper that may not have made the Comedy Channel: Some years ago, it was upheld in a CA supreme court that the police do NOT have the responsibility to protect you from things, including drunk drivers. Someone sued the LAPD for derelection, on the grounds of "where is a cop when you need one."? They lost. It seems the police are only charged with aiding the common good, not preventing the individual from harm. The morally righteous folks protested, to no avail. So we might ask:
"Why can you sue McDonalds for coffee that's too hot, but not the police when someone is killed by a felon whom THEY released?"
