Do my little eyes deceive me? Help fast

Is this a Brabanter Rooster??? I think I heard crowing this morning. Hard to tell as we live in the city and a neighbor several several doors down has a small backyard flock. We are not allowed roosters within the city limits. But guess what we also live very close to the city park which has a large pond with ducks, geese and wild chickens.

Also, does something look wrong with him, his head seems to be cocked weird? One pic is of what I believe is the hen (Dark photo)..the others are of what I believe is the rooster. Need to know asap as roosters are not allowed inside city limits.

Sorry, its already dark can't get any more photos...I am pretty sure he is a he... The one picture of the chicken that is kinda a dark picture I am thinking that is the hen.

Also, how old is this chicken?
Bought in middle of May 2020, approx the 15th, this one and the other like him were 3 1/2 mo in May. So 5 1/2 now...think I heard him crow this morning very lightly. My understanding is most roosters start crowing around 5 months, so this would be about right. The breeder here in Rockdale, Texas guarantees hens so she is taking him back and replacing him. Brabanters are known for being very loud and alarm like Guineas, very surprised I haven't heard an attempted crow before now.

Yes! I am not sure how that happened, that and the sound he made this morning is what made me start looking closer at him. His longer tail feathers are falling over to the left side not holding them up. I have a friend that knows more about chickens then I do coming to look at him tomorrow.

They refuse to roost on the perch, prefer to sleep on the ground and pile on top of each other. I have 2 Self Blue Cochin 6 1/2 mo, 2 Dark Brahma 6 1/2 mo, then the 2 Brabanters 5 1/2 mo. The Brahma sare going to a new home tomorrow they are just too big for the others...they are huge compared to them. Maybe them sleeping on top of him did something.......????? He was fine 2 days ago, I am out in the pen everyday with fresh water and feed.....

If it sounded like a starter hung up, then he's a little rooster & he looks like one! Sorry to say so
