I agree, before you start pounding stakes, get something else or someone else to back you up. The way this lady seems to be interpreting things and reacting, she will likely take it to the next step anyways. Soooooo, make sure you have all of your ducks in a row BEFORE hand, you will save yourself some agony.
 
I'd talk to my lawyer and contact the survey company and/or the city (the city has to have their nose in fences here, donno about there) and let them know that there is a problem, that's 100% accurate property lines are a must in this situation.

I agree about the fence in the pond going all the way down... bad enough they're trespassers no reason to allow theft as well.

I would also ask if there is any way at all to stop them driving through your yard... don't know if there is a way, probably not. But given that there is plenty of access to the bit behind you from their property there is no reason for them to be invading your home. There's certainly no reason for them to be doing it for fishing (recreation) when they could access the spot from their property.

Something is very wrong with that situation... let your lawyer be your guide...

They can use the easement, to go across Camelot's property, to access property at the rear of Camelot's property, pond?

But ain't no way they should be trackin up the whole place.

Let'em fence whatever they want across that pond, and when they are done, add your fence on your side of their fence. After all a fence is a fence, okay for them it's okay for you.
 
Funny you say that as I just pictured two fences... just a human-width apart... with Enter Easement Here... and all the rest blocked... bet it'd be fun trying to wrangle a fishin' pole through that.

Thought of a couple things...

Is it possible they're trying to drive you nuts, and the value down, so that you'll sell it back to them cheap? Couldn't very well sell it to anyone else without openly disclosing the easement problem now could you? I don't know these people, but for some this wouldn't be out of the ballpark of possibility.

Measuring the lines... shores change. If you measure it in wet weather, X feet, then in summer the water evaporates and you actually have less than X feet. And vice versa. If they measure it in dry weather, then they'll have quite a bit more when it's rainy. I'd make sure that the measures they are using are permanent... following the property lines and cutting straight across the pond... otherwise they might just decide to argue that they're entitled to that X feet of shore even in deep dry summer and can use it as an excuse to get on your side.

Fish... you know what you stocked right? Were those types already in this pond, or was it a totally new species? If the only ones in there are ones you put in there then they are yours and easily traced. Post a sign saying so... "All SuchAMuck Fish in this pond are the property of ____ and are subject to catch and release"... or something like that... *shrug* donno if that's possible... ask the lawyer... but if it is then I'd jump on it.[/color]

Also, one more thing I thought of.

If that easement goes across Camelot's property, if I was her I'd fence it in, two fences side by side the width of the easement the entire length of the property, no exit onto my property.

Pineapple I think we have the same thought.

Couple other things...

They are not the only ones that use the access road. There are at least 2 other property owners farther back. So it makes sense she can use the easement to get to their property back there. They bring 4 whlrs through and ride on their property etc.

The other family just has hay fields so about 4 or 5 times a year, they bale and pull hay out. The 3rd family has a cabin back there and on 4 or 5 weekends a year will use the access rd. That gets a little busy cause they bring the whole family and everyone has their own truck I think...lol. But, they have actually added a 2nd access rd on the far side of their land that comes out on a main rd, so that will but down on a lot of traffic from them.

And they let Hubby turkey hunt in the Spring and Fall and let my kids walk on the paths on their property as long as they are respectful and dont make a mess or damage anything. So I can tolerate a little traffic there...lol.

All of this land was owned by Mandy Hearl. When she died, her neices and nephews chunked up the land and sold it in blocks. The house and land that we have was one of them. Then our cranky neighbor's now deceased hubby bought hers and his brother bought the land that is on the left as you look at the plat. Its just pasture land. Nice and quiet

She then chunked her big piece up and 2 of her kids have houses here too.

I know some readers must think that I am just being a stinker...and in some ways, I probably am. But this is the same cranky person who once yelled at my kids when they were walking to the bus for stepping off of the gravel and onto the weedy/grassy edge of her yard. They had been walking and talking and DD (then age 6) had wandered/listed too far to one side.

We are very diligent about keeping our animals and our kids in their own yard, so this whole fence thing has just blown my mind.
In fact, I have a duck who had been sneaking over before dawn and had laid a nest of 20 monster duck eggs in her shrubs. She was nice enough when she brought the bucket of eggs over and told us where she had found them. Since then, I have my coffee sitting on my screened in porch waiting for mama to waddle through between 7 and 7:30 and then I dart out with my broom and scold her back home. I am hoping that a few more brushes with the broom will keep her from heading over there anymore. Now, thats dedication...lol. And I baked a loaf of fresh bread and delivered it to her as an apology for the ducks naughtiness.

I just dont understand the need to put a fence through the pond or the need to trek across my yard but holler at DD for stepping off the road.

I am not sure if I missed this BUT have you out right asked her why the need for the fence? Maybe she thinks she is doing it for everyone's benefit or something, you never know what she could be thinking......
