If they encounter fencing on more than one side, they are penned, not free range.
The caveat on free ranging is, what size is your property and could your chickens encroach on neighboring property?

As long as it's not prohibited you can do as you like, but keep in mind that chickens don't respect property lines and your neighbors may not appreciate having chickens pooping on and destroying their yard. You will also need to accept that predator loss is a risk of free ranging.
