Frizzle: pullet or rooster?

Here is a pic of my frizzle at about 5 weeks old. His/Her comb is pretty red, and it also has very bright red waddles coming in.

that's what I thought. I am sorta okay with it... As long as we don't get in trouble for having chickens in the first place. I can't wait until more of his feathers come in.
