Frustrated with Neighbors

Harlans: It's not a crisis to YOU because you don't have ATVs and snowmobiles and horses creating havoc on your property and running over your chickens but believe me, when you've got a problem like this, you better believe that BYCers will be there for YOU.

They do in Montana, if you get a permit, you can go anywhere on State easements

get some Cocoa out and make some friends...

There are many types of easements and just because it's has the name "easement" doesn't mean anyone can travel on it. The power company supposedly has a 20 ft easement from the power lines onto my property and because I pay taxes on every inch of my acreage, I fenced the perimeter of about half of it, easement or not. It could be a liability nightmare and you could be sued if one of the kids gets hurt on your property. If you pay taxes on it, it's private property, whether there is an easement or not.

If your neighbour/state allows it is probably legal, if that is the wording in the easement.

My easement is for the county tile only. The drainage board and I have a good relationship. We go out of our way to try and help them because of the stories I have heard about the previous owner and threatening the poor workers with guns. In return they are going to help us when they tear up our pasture. They are going to reset all the posts that come out. They don't have to but he offered.
As to the neighbor than ran over the hen in my yard... he lives 2 miles away and he was 30' in front of my house. The road is 100' in front of the house. No excuses. That would be like me seeing a mud puddle in his yard and taking my truck over to have fun.

I am pretty sure I have seen the Op post about this before and its been an ongoing problem. Not positive but I think so.

Anywho it really does depend on your easement. We also have one that goes up the middle of our property. It is an easement simply for the utility workers and for no one else. Thankfully all our neighbors have the same issues and everyone is very respectful about not trespassing. We also had an easement up the backside of our property that a previous neighbor took it in their head that they could use for their atv. Tore the living heck out of it. It was the only path back there for workers and they could not reach areas any longer because of the damage done. Their parents ended up having to repair it. Once it dawned on them that what their son did on our property could very well affect them too they stopped the joy rides. Again thankfully people out this way have been respectful enough so far. I think because we are all in the same boat honestly.

We also have an easement between houses at our house in town and it has to be open to utility, city workers and both owners. BUT that easement is actually half owned by them and half owned by us. They took a 2 ft strip from each property owner. Its part of the city ordinances.

This isn't just about easements though. From what the OP stated they have attempted to steal a game camera from her property and have ridden through her yard. Her entire yard is not the easement. I would personally not talk to the parents first. I would send a certified letter and then follow it up with a visit and a talk. C.Y.A. and then each and every time it happens again I would insist on filing a report. more C.Y.A. Then and only then would I be seeking advice from a lawyer.

I guess we have it pretty good with our electric company. Just call them and they will send you a padlock so you can gate your roads if you want. Thier locks are all keyed alike so their workers can get where they need to go and you can keep everyone else out at the same time.

In AR ATVs are not allowed on highway right of ways.
