I just talked to my DH who worked for the county here, he said that yes that part belongs to the county but.The county is responsible for maintaining that part and also if someone gets hurt on it, it is the county's problem not yours unless you put something in the right of way that caused the injury. DH said to put a fence up on your property and no trespassing signs and stop maintain that piece of land and let the county do it. As long as they can not ride their atv's on your property you should be fine. I would also get camera's up so you can see if they are on you property then report them to the sheriff for trespassing to cover yourself. I wish you luck but I would get a fence up on your property and let the county take care of that right of way wash your hands of it. That way since you are not maintain it you are not responsible for it. The county telling you that you could be held liable is a way to scare home owners into if someone getting hurt and paying so they don't have to. The county here does it all the time. Good luck. I hope you can fix this problem. A good property attorney would help.

Ive been thinking about that anyway, putting up a fence across the front. Only reason I havent is that people tend to slide into my property when the roads are slick, so the fence would be taken out alot in the winter. I know they would have to pay for having to replace the fence, I just dont want to come home with a car in the middle of my yard.
Im gonna talk to the people previously mentioned. If they say I cant do anything, then I will probably just stop mowing it and let it grow. If anyone says anything, I'll just say, the county is responsible for it, not me. Less for me to mow.

I had a similar problem on some property several years ago. I put large boulders and started dumping brush where the trespass was happening it became unusable and the trespassers went somewhere else to ride and walk.

We both have flowers planted on the bank, Iris's, that I gave her when mine decided to go ape and grow like crazy. The county comes along once and a while and mows down the trees but they have never mowed down the flowers.
We are talking about ten/ fifteen feet that is from the corner of my property pin marker to the road.
No, I did not know that there was a right of way, I thought my property went all the way to the road. If I dont mow it, there will be lots of tall grass and will look unsightly.
There is more to it than just wondering if its my land and I can prevent them from using it. They are doing it because my survey proved thiers wrong and they didnt have as much property as they thought they did. I reclaimed what was legally mine. Plus, I made them move thier dog house off my property.
I will have to ask the deeds office about purchased and non-purchased land.
Doing nothing HAS been suggested. Many times. By people who dont have to put up with the harrassment I have.

Thats a good idea. Of course, my luck, the county would come along and make me clean it up since its near the road. I have thought of putting horse manure up there saying Im fertilizing the grass<eg>.

However, I did go talk to the Deeds office today, and the guy who makes the maps for the county, and they told me what Ive already been told. Its a right of way, not an easement, and the right of way is from my corner pin to the middle of the road which measures 25 feet. I cannot block it off with tposts or bushes or anything. I cant keep people from using it to ride, walk, or drive on it. In fact, a couple years ago, I had a nice maple tree planted there, not knowing it was the right of way, and they cut it down to keep it from growing into the lines above. I was ticked. It was just starting to look nice. They did replace it though and told me to plant it about 50 feet back, which I think thats about where I put it.

I am debating, now that I know there is jack I can do about it, about whether or not I'll keep mowing it. I might not, just to tick off the neighbors. I did get my No Trespassing signs and put them on each corner of my property. I used roofing nails. Those puppies are a pain in the keester to get out.

Im also ordering some security cameras for the house. Thats about all I can do. And hope in about five years the little bleeps next door are gone and the dog dies. Course, they just got another dog, an American bulldog<yippee> that will probably be put out there when this one they have out there now passes away. Goodie for me.

I've been lurking this thread and reading with interest. I'm sorry your having to deal with jackasses... So your not aloud to block the 25 feet from the road right? But can you block it on the side the runs closet to your property? I don't understand, what is your land, not the right of way.. Plant a line of ceders trees? There not gonna grow the way a maple would. Just straight up, Theg are no more then 5-10 around. So plant them 10 feet on your side?
And of course your idea of letting the grass go will help alot in the summer, but in winter? Will the grass dye and let the 4 wheeling begin again?

I wouldn't waste the gas to mow it anymore. Dig up the flowers you planted and walk away. If the county complains tell it's not your responsibilty anymore. Their right of way their problem.
Run a fence all around your property and that is that.

I think in your situation I might put something in the right of way on occasion and see if the county will clean it up and if not you have helped solve part of your problem.
