How do earthworms...

get into a birdbath that's 3 feet off the ground

Bird flies by with it in it's mouth, gets spooked by another bird and drops it into the bird bath!

Someone else suggested that, too. The birdbath is mostly under a bush. Seems weird that a worm-eating bird wouldn't swallow the worm right away.

If it happens during after a storm, it might be possible that the earthworm may have been carried in the rainclouds....not sure if rainclouds can "hold" items like that. Fishes have been found flopping in backyards during a storm.
