How old does a rooster have to be to make an egg fertle?

Basically, if he mates them, he should be fertile. If he is not mating them, the eggs will not be fertile. You can check fertility by cracking an egg into a bowl and looking for the "bullseye" that indicates fertility (if you do a search on the forum you can find threads with pics of what fertile eggs look like - sorry, I don't have the threads bookmarked). However a 12-week old roo probably is NOT yet mature enough to mate so it is unlikely your eggs are fertile yet.
 
I hatched chicks from my EE roo when he was 14 weeks old so it's possible. The only way you will know for sure with the ones in the bator is if they start to develope. You can also check some that you haven't put in there to look for the bullseye.
