Is this Rhode Island Red a Roo or a Pullet?

Crap if ya near me I'd take one. My big RIR just died and I have his son but his mother is my GLW. I'd rather have a pure RIR roo. Jr looks like his dad but worried he's gonna pass smaller egg laying genes down later on.

where are you located at? I live in Ohio.
 
Is there a reason you can only keep one? I know it's hard for some but if you have enough hens it shouldn't be an issue as they do have heirarchy and know their "place" lol!
i think it might be bc different cities have different rules so i think they can only have 1 rooster
