Legal Advice Needed

These laws only apply when you have other properties within a given distance from your boundaries (can't remember how far off the top of my head), and do not apply to nature. They do not specifically apply to roosters either, just ANY noise source that may be an annoyance to others. We do not have laws that say you CAN keep chickens or roosters, we merely have property covenants that say when you CAN'T.

I believe this is different in the US isn't it? Am I right in thinking you have laws in particular areas which say you cannot keep livestock at all? Surely this is more ridiculous? A blanket ban on livestock seems a bit over the top. In the UK there is no such ban ANYWHERE but individual houses may have covenants, byelaws or restrictions written into the deeds and urban councils have a 'duty of care' to its residents to ensure noise levels are not unreasonable. This would apply whether it was your neightbour's crowing cockerel, their trombone playing five year old, their heavy metal loving teenager or their elderly grandmother listening to the TV too loud!!

So, the law does not state you may have chickens but must keep them quiet, it states you must me a reasonable and considerate neighbour if you live in close proximity to others....despite having had to give up some very much loved geese because of these laws, I agree with them totally. It is extremely unpleasant to have noisy neighbours....I would not want to be woken by a cockerel at 5am despite being an absolute nut over my chickens. I equally would not want to be kept awake by barking dogs, loud music, arguing people or any other such things so am glad the law is there to protect me....but it's there to protect the person being complained about from over-reactors....hence the noise tests.

I completely agree but I sleep at the back of the house and can't hear a single thing .
 
The people from the council came by today and says that we have to ensure that the she'd is more light proof and that he can't raise his head or we'll have to get rid of our rooster but I think he agrees that my neighbours are being slightly ridiculous as we were I the back of the house for around 2 hours and there was not one peep out of him so I'll try to keep you all up to date on our chicken shed improvements over the next couple of days but these noise and nuisance laws are just ridiculous chickens are a part of nature and should not be silenced .

I very much feel for you Niamhblond, having been in the same situation. Maybe if the tests are done and there genuinely isn't a case to answer, you can relax a little.

You're learning early in life that it and people are not always fair or just or logical...and sometimes there's not a darn thing you can do about it.

Can't help but wonder what your parents' role in this is...as I assume 14 is a minor status in Wales as it is in the US?

My parents completely agree with me that it's unfair and are helping to the best of they're abilities but I don't think they can see hurricane as a pet , like I do and you're correct I am learning that some people arnt logical . Thanks for the support x
 
What's your set up like? I can't help thinking that a 2nd hand eglu go inside a garden shed type structure wouldn't be as noise proof as all get out for Roo sleeping quarter. Hedging also muffles noise.

I'm also in South Wales and despite living in an area where people keep ponies in their garden shed, have a restriction on livestock and poultry that I'm asking very nicely to have lifted right now. Daft as anything considering it's a semi with only fields behind me. Hard to hear chooks over the wild sea gulls too.. Our bantams are my son's pets and I won't be giving them up without a fight (or at least an explanation as to why ponies are OK but chickens not!).

I would ask your immediate neighbours to put it in writing that your Rooster doesn't upset them as a first step. If noone else on the street finds him a pest bar one resident then Mr Moaner starts to look a bit isolated and silly.

Although I wish we could have kept him sadly Hurricane had to go and if you do try to go about getting the law changed you have my support. Where I live theres a rather big road that goes up our street and cars are very loud revving there engines and racing up and down the street at night . So what I don't understand is how they can put up with that but can't put up with the sound of wildlife.
